The European Union’s Regulation on harmonized rules on fair access to and use of data – known as the EU Data Act – which will come into effect in September 2025, is a newly introduced cross-sectional piece of legislation which will have a significant impact on the rules governing access to and use of data in the European markets. All companies which provide products or services in the EU, such as those which manufacture connected devices (internet-of-things (IoT) products) collecting data, can be subject to the EU Data Act. In addition, non-compliance can result in significant fines and risk hindering current operations from continuing in the first place, therefore, it may be necessary to conduct a risk assessment in a way that is similar to but not the same as the EU’s General Data Protection Regulation (GDPR). For that reason, Japanese companies must also understand and comply with the new rules.

In this seminar, Mr. Naka will explain in an easy-to-understand way from a practical viewpoint the obligations that Japanese companies must comply with and how to deal with them, after understanding the entire legal system of the EU Data Act.
