Claims for Damages concerning the Violation of the Duty of Care Owed to an Employee of a Foreign-affiliated Company

Kitahama Partners represented a foreign-affiliated company in a civil action concerning the violation of the company’s duty of care owed to an employee, challenging the argument of whether travel time on business trips constituted working hours, and obtained a judgment of dismissal with prejudice denying it.

The Kitahama Partners team which handled the case was led by partners Tatsuhito Shiotsu, Yasumasa Sakamoto, Yuki Kawata, and Koji Tomimoto, and was supported by Saki Fujiwara.
